Aquaculture Ltd terms and conditions of sale
These terms and conditions are an agreement between you and Aquaculture. They'll govern the contract of any sale you enter into with us.
1. General
1.1 By placing an order with us, you agree to be bound by these terms and conditions.
1.2 When you place an order with us, you agree to purchase our product(s).
1.3 You must be at least eighteen years of age to purchase any product from our website.
1.4 We reserve the right to refuse to sell you any product that you order from us.
2. Pricing
2.1 Prices on our website and in our catalogue don't include delivery expenses. For more information, please go to delivery charges.
2.2 You are given the price of each product you purchase from us when you place your order. We reserve the right, for any reason, to amend this price. In the occurrence of such an event, we'll contact you with the correct price. You'll then be given the option to either proceed with the order or cancel.
If you've already received your order, you can either pay the extra amount due to us or return the product. If you opt to return, we'll fully reimburse you with the amount you paid for the product and all delivery charges.
2.3 Special offers and promotions are subject to availability and only for the time period quoted.
2.4 You only own any product you order from us once we receive final payment.
3. Availability
3.1 On rare occasions we may be unable to deliver the product(s) that we have agreed to. We'll always fully reimburse you with the price you paid for the product(s) and the delivery charge (if applicable). However, we'll not be held liable for any loss which results from this lack of availability.
3.2 We also reserve the right to change any product that you order from us. But we guarantee that this product will be equivalent in terms of functionality and performance.
4. Delivery
4.1 When you first purchase a product from our website you create an account with us.
4.2 As stated in clause 2.1, prices which appear on our website and in our catalogue don't include delivery expenses. For more information, please go to delivery charges.
5. Returns
5.1 Aquaculture will offer a full refund or exchange for any product you return within 30 days of purchase. However, the product must be unopened and in its original condition. You'll also be responsible for the cost of returning the product.
If you are unable to send a product back to us, we can arrange to collect the item from you. But you'll still be responsible for any delivery charge incurred. Please note, if you ask us to arrange collection, as we use a courier service, you'll not be able cancel this request.
5.2 If you receive a faulty product from us, we'll offer you either a full refund or exchange. We'll also reimburse any delivery charge you've paid and cover the cost of returning the faulty product. If you wish, we can even arrange to collect the item from you.
However, you must inform us of the fault, in writing, within seven working days of delivery. If you fail to do so, we'll be unable to commit to any of the above.
If the product is found to be without fault, you'll be charged a 10% administration fee of the price you paid for the item. You'll also be held liable for all postage and packaging costs.

6. Miscellaneous
6.1 If any of these conditions are deemed invalid and/or unenforceable, it'll not affect the remaining conditions.
6.2 If either party does not seek to enforce their rights under these terms and conditions, it'll not prevent either party from being able to take action in the future.
6.3 This agreement between you and us shall be governed by English law.
6.4 We reserve the right to amend the terms and conditions of this contract. By purchasing a product from us, you accept our right to do so.

1. Use of the Aquaculture Website

1.7 You'll be charged for any unauthorised use of our website. Charges are fixed at £200 per image/graphic per day and £4.00 per day for each word used.

2.2 You agree to take all reasonable precautions to ensure that no one else uses your account.
2.3 You agree to contact us immediately if you've any reason to believe that your password is no longer safe.
2.4 You agree to provide us with correct information when you register and to inform us if you change any of these details.
2.5 You agree not to impersonate and/or provide the details of any other person (living or dead).
3. Privacy
3.1 We comply with the Data Protection Act 1998.
3.2 We'll only use your personal details to complete a sale you 've agreed to enter into with us.
3.3 We'll only store your personal details if you ask us to.
3.4 If you opt-in to receive our e-newsletter, you agree to be sent any information that we think you may find valuable. This may include promotional information.
3.5 You've the right to unsubscribe to our e-newsletter at any time.
3.6 If you ask us to store your personal details, we'll always let you've access to this information. You can also request to have your personal details edited or deleted.
3.7 We only use cookies to keep track of what you put in your basket and to measure the usage of our site.
3.8 We don't and never will sell, rent or distribute the information you give to us.
4. Disclaimers and Limitation of Liability

4.4 We'll not be held liable for any injury, damages, costs or any other financial loss as a result of unauthorized access or alteration to our website.
4.5 Transmission of information via the Internet may be subject to delay. This could postpone the execution of your order. We'll not be held liable if such a delay causes you and/or a third party financial loss.
4.6 When using our website, we recommend that you use your own protection software. We'll not be held liable for any damage or financial loss that may result from the transfer of a virus to your system.
5. Reviews
5.1 When you submit content to Aquaculture, you agree that we may copy, modify, distribute and/or create an imitative copy of your work in any form.
5.2 You agree not to submit any content or material that is defamatory, offensive, obscene or in any other way illegal.
5.3 If you submit a product review to us, we are only obliged to give you to a £5 e-voucher if we publish your material on our website.
5.4 E-vouchers for customer reviews will only be redeemable on orders over £100 (excludes delivery costs).
5.4 You can only redeem one £5 E - voucher per order.
6. E-newsletter
6.1 If you have not registered with us, we'll give you a £5 e-voucher when you sign up to our enewsletter.
6.2 When you sign up to the e-newsletter, we'll give you a £5 e-voucher.
6.3 You'll be able to redeem your e-voucher on orders over £100.
6.4 For signing up to the e-newsletter, we'll only give a user one e-voucher.
6.5 You can only redeem one £5 e- voucher per order.
7. Our Rights
7.1 We reserve the right to make amendments to the form and content of our website.
